According to this organization, damages caused by “the annual passage of more than 50,000 ships and tankers through the Strait of Hormuz and their role in the pollution of the Persian Gulf” must be compensated, and the regulation is consistent with the provisions of the United Nations Convention on the Law of the Sea.

Under this plan, if the principle of “innocent passage” is violated and an environmental threat is created, Iran may collect a “fee” depending on the type of ship, the amount of cargo, navigational records, and the record of pollution from the vessels passing through.

The United States and its allies say that collecting any kind of charges violates the principle of free navigation in international waters.

Iran says that the Strait of Hormuz is not international waters and that it is the territorial waters of Iran and Oman, and that collecting fees from passing ships is permitted under international laws.
